Welcome to progressive-am.com (the “Site”), operated by Progressive Association Management, Inc. (“Progressive,” “we,” “us”). By using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.

The Site, including our blog, FAQs, guides and videos, shares general information about HOA management. It is not legal, financial, tax or insurance advice. Every association’s governing documents and circumstances are different, so please consult qualified professionals before acting. Your board keeps its fiduciary and legal responsibilities for your association at all times.

Our pricing calculator gives an estimate based on our published rates and the information you enter. An estimate is not a quote or an offer. Final pricing is set out in a written proposal and becomes binding only when both your association and Progressive sign a management agreement. Communities with active litigation, unusual reserve positions or special requirements may be priced differently.

The Progressive Guarantees described on the Site are summaries. The full terms, including how fee reductions are applied, are set out in each association’s signed management agreement, and that agreement controls.

You agree to use the Site only for lawful purposes. Please do not:

• Submit false, misleading or someone else’s information through our forms
• Try to interfere with the Site’s security or operation, or access areas you are not authorized to use
• Use automated tools to scrape or copy the Site’s content
• Upload or send anything harmful, unlawful or infringing

The text, graphics, logos, photos, videos and other content on the Site belong to Progressive or our licensors and are protected by copyright and trademark law. You may view and print pages for your own personal or board use, and you are welcome to share our one-page overview with your board. Please do not otherwise copy, change or distribute our content without written permission.

The Site links to websites we do not control, including our Client Portal, which is provided by CINC Systems, and our social media pages. Their own terms and privacy policies apply, and we are not responsible for their content or availability.

Our Privacy Policy explains how we collect and use information shared through the Site.

We work hard to keep the Site accurate and up to date, but it is provided “as is” and “as available.” To the fullest extent allowed by law, we make no warranties of any kind about the Site, including that it will be error free or always available. Figures such as community counts and review totals are updated periodically and may change.

To the fullest extent allowed by law, Progressive will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site. This section does not limit any obligations under a signed management agreement.

If any part of these Terms is found to be invalid or unenforceable, that part will be enforced to the fullest extent allowed by law, and the rest of these Terms will remain in full effect.

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Continuing to use the Site after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of California. Any dispute about the Site will be handled in the state or federal courts located in [To confirm by PAM: Orange] County, California.
